The FMCSA Drug and Alcohol Clearinghouse is a federally mandated, secure online database that tracks violations of the U.S. Department of Transportation’s (DOT) drug and alcohol testing program for commercial driver’s license (CDL) holders. Employers regulated by the Federal Motor Carrier Safety Administration (FMCSA) are required to use the Clearinghouse to verify that drivers are eligible to perform safety-sensitive functions in accordance with 49 CFR Part 382 and 49 CFR Part 40.

FMCSA Clearinghouse Compliance Requirements

The FMCSA Clearinghouse rule was published on December 5, 2016, and became effective on January 6, 2020, establishing a centralized system for reporting and reviewing specific drug and alcohol program violations for CDL drivers. The Clearinghouse contains records of violations of the DOT controlled substances and alcohol testing regulations, as defined in 49 CFR Part 382 and 49 CFR Part 40.

Employers are required to use the Clearinghouse to:

  • Conduct required pre-employment and annual driver queries.
  • Verify that drivers are not prohibited from performing safety-sensitive functions.
  • Ensure that reported violations are resolved before a driver returns to duty.

The Clearinghouse does not replace an employer’s drug and alcohol testing program. It is a required verification and reporting component of FMCSA compliance.

Who Is Required to Use the FMCSA Clearinghouse?

CDL Drivers

CDL drivers are required to:

  • Register in the Clearinghouse.
  • Provide electronic consent for employer queries.
  • Select a Substance Abuse Professional (SAP) following a violation, if applicable.
  • Complete the return-to-duty process when required.

Employers

FMCSA-regulated employers must:

  • Conduct required Clearinghouse queries before hiring a driver and annually thereafter.
  • Ensure no driver performs safety-sensitive functions with an unresolved violation.
  • Designate authorized representatives or C/TPAs, if applicable.
  • Maintain compliance with reporting and recordkeeping requirements.

Consortium/Third-Party Administrators (C/TPAs)

Authorized C/TPAs may:

  • Perform Clearinghouse queries on behalf of employers.
  • Report violations when permitted by regulation.
  • Provide administrative support under employer authorization.

Medical Review Officers (MROs)

MROs are responsible for reporting:

  • Verified positive drug test results.
  • Refusals to test.
  • Certain cancelled tests, as required under DOT regulations.

Substance Abuse Professionals (SAPs)

SAPs are responsible for reporting:

  • Initial evaluations.
  • Completion of education and treatment.
  • Eligibility determinations for return-to-duty testing.

State Driver Licensing Agencies (SDLAs)

SDLAs are required to query the Clearinghouse prior to completing certain CDL licensing actions to verify driver eligibility.

Consequences of Noncompliance with FMCSA Clearinghouse Requirements

Employers subject to FMCSA Clearinghouse requirements must comply with reporting and query obligations in accordance with 49 CFR Part 382. Failure to conduct required queries or ensure that drivers with unresolved violations are prohibited from performing safety-sensitive functions may result in FMCSA enforcement actions, including notices of violation and civil penalties assessed on a per-violation basis.
